Platform Transparency Notice

The Club Cult is operated by AGENCY CULT SASU, a simplified joint-stock company incorporated under French law.

1. Purpose and status

Agency Cult SASU operates the Platform under the brand The Club Cult. It is an online platform operator within the meaning of Article L111-7 of the Code de la consommation, and an online intermediation service within the meaning of Regulation (EU) 2019/1150 (the P2B Regulation). This notice gives clear and transparent information about how the Platform connects its Users, how Experts and Curators are ranked, how reviews are handled and how commercial terms apply. Terms written with a capital letter have the meaning given in the Legal Definitions Master.

2. Who we connect

The Platform connects three categories of User. Members are individuals who use the Platform in a personal capacity and are treated as consumers. Experts are professionals who offer Services. Curators are organisations that host Events and may engage Experts. Experts and Curators act as professionals.

3. Ranking of Experts and Curators

When a Member browses or searches, Expert and Curator profiles are presented in an order produced by the Platform. The principal parameters that determine that order, and their relative importance, are set out below. The order is generated to help a Member find the most relevant and available professional, not to favour any commercial interest of Agency Cult SASU.

4. Differentiated treatment

Agency Cult SASU does not offer its own competing Services and does not give preference in ranking to any offering that it controls. The Commission rate that applies to an Expert, which is 20 percent for a freelance Expert and 10 percent for an agency-represented Expert, does not affect that Expert position in the ranking. Agency Cult SASU does not accept payment from a professional in exchange for a higher ranking. If paid placement is ever introduced it will be clearly identified as advertising.

5. Commercial relationship affecting the offer

Agency Cult SASU earns a Commission on each Service paid through the Platform. This commercial relationship is described here for transparency. It is set by role type as stated above and is applied through Stripe Connect at the point of charge. It does not change the order in which professionals are presented.

6. Reviews

Reviews and ratings published on the Platform come from Users. In accordance with Article L111-7-2 of the Code de la consommation, we take reasonable measures to publish genuine reviews that relate to a real experience on the Platform, and we describe whether and how reviews are checked. We do not buy reviews and we do not alter the content of a genuine review. We may remove a review that is unlawful, that does not relate to a real experience or that breaches these terms.

7. Status of sellers

In accordance with Article L111-7-1 of the Code de la consommation, Experts and Curators present on the Platform act as professionals. A Member contracting a Service contracts with a professional Expert. The consumer protection rules of the Code de la consommation apply to that relationship.

8. Main terms for business Users

The commercial terms that apply to Experts and Curators, including the Commission, the payout mechanics, the escrow and dispute process and the conditions of access, are set out in the Booking and Payment Terms and the Expert Terms or Curator Terms accepted at onboarding. Any change to these terms is notified at least 30 days before it takes effect, in accordance with Article 3 of the P2B Regulation.

9. Internal complaint handling for business Users

In accordance with Article 11 of the P2B Regulation, an Expert or Curator may submit a complaint to Agency Cult SASU by email to legal@theclubcult.com. We acknowledge a complaint within a reasonable time, we examine it diligently and we communicate the outcome. We aim to acknowledge within 15 days and to provide an outcome within 30 days.

10. Mediation and redress

A business User may seek mediation of a dispute in accordance with Article 12 of the P2B Regulation. A Member who is a consumer may use the consumer complaint and mediation process set out in the Terms of Use.
