The Club Cult is operated by AGENCY CULT SASU, a simplified joint-stock company incorporated under French law.
These Curator Terms govern the relationship between Agency Cult SASU and each Curator. They supplement the Terms of Use and the Membership Terms. A Curator is a professional organisation, such as a brand, house, PR agency, cultural institution or event organiser. A Curator that hosts an Event is the host of and is responsible for that Event. Terms written with a capital letter have the meaning given in the Legal Definitions Master.
A Curator completes onboarding and may create a professional page representing its organisation. The Curator is responsible for the accuracy and lawfulness of everything published on its page and in its Event listings, and warrants it has the right to use any name, brand or content it publishes.
A Curator may create and publish an Event, invite Members and manage registrations and the guestlist through the Platform tools. The Curator delivers the Event as described, or notifies registered Members promptly of any material change or cancellation. The Curator complies with all applicable law in connection with its Events, including consumer protection, safety and, where the Event is ticketed or paid, the rules applicable to that sale.
Where a Curator engages an Expert through the Platform, the Booking and Payment Terms apply, and the Commission and payment mechanics set out there apply to that engagement.
A Curator communicates with Members through the Platform messaging system. A Curator does not contact a Member off the Platform without the Member separate consent, and does not use Member data obtained through the Platform for any purpose outside the Platform, in particular not for direct marketing, without the Member separate and informed consent. A Curator complies with the GDPR and French data protection law for any personal data it collects, acting as an independent data controller for that data.
The Curator treats as confidential the identity of attendees and any personal or private information learned through the Platform, and does not disclose, publish or use it outside what is necessary to host the Event. This obligation survives the end of the Curator Membership.
Where an Event involves professional photography or filming, the Curator flags this when creating the Event so that registered Members can give or decline their consent at registration. The Curator is responsible for the lawful capture, use and publication of any image or recording made at its Event, including obtaining any consent required under data protection law and image rights, and for respecting a Member who has declined. Agency Cult SASU is not responsible for media captured or published by a Curator.
The Curator Subscription and any applicable fee are those published on the website Pricing Schedule, stated in euros inclusive of French VAT at 20 percent (TTC). The Membership Terms govern the Subscription.
The Curator complies with the Acceptable Use rules and the Non-Discrimination rule in the Terms of Use, and does not publish content that is unlawful, infringing or misleading.
Agency Cult SASU may suspend or terminate a Curator account for a serious or repeated breach of these Curator Terms, the Terms of Use or the Membership Terms, for fraud, for a credible safety or legal concern, or for conduct that harms a Member or an attendee. Obligations that arose before termination survive.
The Curator is responsible and liable for its Events and its published content. The Curator holds Agency Cult SASU harmless against any claim by a Member, an attendee or a third party arising from its Events or content, except to the extent the claim results from Agency Cult SASU own failure. Nothing in this section limits liability that cannot be limited under French law.
These Curator Terms apply for the duration of the Curator Membership. We give at least 30 days written notice before a change takes effect, in accordance with Article 3 of the P2B Regulation. Continued use after the effective date constitutes acceptance.
