Account Deletion and Data Rights

The Club Cult is operated by AGENCY CULT SASU, a simplified joint-stock company incorporated under French law.

This document explains your data protection rights, how to export your data, and how to delete your account. It is part of, and consistent with, the Privacy Policy. Terms written with a capital letter have the meaning given in the Legal Definitions Master. For any request under this document, contact legal@theclubcult.com.

1. Your rights

Under the GDPR and French data protection law you have the rights set out in the Privacy Policy, namely access (Article 15), rectification (Article 16), erasure (Article 17), restriction (Article 18), data portability (Article 20), objection (Article 21) and the right to withdraw consent (Article 7). You also have the right not to be subject to a decision based solely on automated processing (Article 22), and The Club Cult does not take such decisions.

2. How to exercise a right

You can exercise a right from within the Platform, in Settings, or by writing to legal@theclubcult.com. We respond within one month of receipt, which may be extended by two further months for a complex or numerous request, in which case we tell you within the first month. We may ask you to confirm your identity before we act. A request is free unless it is manifestly unfounded or excessive.

3. Export your data before you delete

Before you delete your account you can export your personal data, in exercise of your right to portability under Article 20. The export is provided in a structured, commonly used and machine-readable format, JSON or CSV. You can request the export in Settings or by writing to legal@theclubcult.com.

4. Deleting your account

You can delete your account at any time from within the iOS application, in Settings then Privacy then Delete My Account, and on the website. In-app deletion is provided in accordance with Apple App Store requirements. Deleting your account also terminates your Membership, as described in the Membership Terms.

5. The 30-day reversible period

When you confirm deletion, your account enters a 30 calendar day reversible period. During this period your profile is deactivated and not visible to other Users, you cannot make new Bookings, and you may reactivate the account by signing in. At the end of the 30 days the deletion becomes permanent and cannot be reversed.

6. What is deleted and what is retained

On permanent deletion we delete or irreversibly anonymise the personal data held in your account in our Supabase database and storage. We retain a limited set of data only where the law requires it and only for the period required, as set out in the Privacy Policy: invoices and accounting records for 6 years, transaction and Booking records for 5 years, and Expert identity verification documents for 5 years after the end of the relationship. Where data must be retained for a legal reason it is restricted to that purpose. Where deletion of a specific item is not technically possible it is anonymised.

7. Reviews and community content

The objective is to delete your personal account data while preserving the integrity of the Platform and the rights of other Users. Reviews, ratings and community posts that you have published may relate to the experience of other Users. On deletion of your account, your authorship of that content is anonymised, so it is no longer attributed to you, while the content itself may remain where it is necessary for the integrity of another User record or of the community. Where the law requires full deletion, we delete it.

8. Outstanding Bookings and obligations

If you have an open Booking, a pending payout or an unresolved dispute, you are asked to resolve or complete it before deletion is finalised. Obligations that arose before deletion survive it, as set out in the Terms of Use and the Membership Terms.

9. Confirmation

We confirm an account deletion by email. The transactional email follows the standard Platform legal footer.

10. Children

The Platform is for adults aged 18 and over. If we learn that an account belongs to a minor we delete it.

11. Right to complain

You may lodge a complaint with the CNIL at any time, as set out in the Privacy Policy. We ask that you contact us first at legal@theclubcult.com so we can try to resolve the matter.
